You agree not to use the website:
- for any unlawful, fraudulent or unauthorised purpose;
- to infringe the rights of EVADE HOUSE or any third party;
- to attempt to gain unauthorised access to our website, systems or networks;
- to interfere with the security or operation of the website;
- to introduce viruses, malware or other harmful material; or
- to reproduce, copy, distribute or commercially exploit any part of the website without our prior written consent.
We reserve the right to suspend or restrict access to the website where reasonably necessary, including for maintenance, security or technical reasons.
3. Products & Availability
We make reasonable efforts to ensure that product descriptions, images, colours, measurements and other information displayed on our website are accurate and up to date.
However, colours may appear differently depending on your device or screen settings, and minor variations may occur due to the nature of certain materials, fabrics and manufacturing processes.

Some EVADE HOUSE products are available from stock, while others are produced after an order has been placed.
We reserve the right to limit the quantity of products that may be purchased where reasonably necessary.
4. Made-to-Order Products
Certain EVADE HOUSE products are made to order.
A made-to-order product is a standard EVADE HOUSE design that is manufactured after an order has been placed, without modifications to the design, pattern or measurements.
Made-to-order does not mean that a product has been individually customised for the customer.
The estimated production time for made-to-order products will be indicated on the website or communicated to you where applicable.
Production times are estimates and may vary depending on the product and production schedule.
Unless a product is custom-made or another statutory exception applies, the fact that a product is made to order does not by itself exclude any mandatory consumer rights.
5. Custom-Made Products
Custom-made products are products that are specifically developed or modified at the customer's request.
This may include:
- the development of a new design specifically requested by the customer;
- modifications to an existing EVADE HOUSE pattern;
- adaptations made to accommodate specific body measurements or requirements; or
- other alterations requested by the customer.
Custom-made products are specifically produced or modified for an individual customer and therefore cannot be returned or exchanged, except where required by applicable law, including where the product is defective or does not conform to the contract.
6. Prices, VAT, Duties & Taxes
All prices displayed on our website are stated in the applicable currency and include VAT where VAT is legally applicable.
For orders shipped outside the European Union, import duties, customs charges, local taxes and other charges imposed by the destination country are not included in the purchase price, unless expressly stated otherwise.
These charges are the responsibility of the customer and may be collected by the carrier or relevant customs authorities upon delivery.
The customer is responsible for ensuring that the products ordered can legally be imported into the destination country.
EVADE HOUSE is not responsible for delays caused by customs clearance or for customs duties, taxes or other charges imposed by the destination country.
7. Pricing & Product Information Errors
We make every effort to ensure that all information and prices displayed on our website are accurate.
However, errors may occasionally occur.
If we discover an error in the price, product description, availability or other important information relating to an order you have placed, we may contact you before dispatch to confirm whether you wish to proceed with the order at the correct price or with the corrected information.
If we are unable to contact you, or if you do not wish to proceed, we may cancel the order and provide a full refund of any amount already paid.
This does not affect any mandatory consumer rights applicable to your purchase.
8. Placing an Order
You may place an order through our website without creating a customer account.
When placing an order, you are responsible for ensuring that the information you provide is accurate and complete, including your name, billing address, delivery address, email address and payment information.
Before submitting your order, you will have the opportunity to review and correct the information provided.
Once you place an order, you will receive an email confirming that we have received your order.
This email acknowledges receipt of your order and does not, by itself, constitute acceptance of the order.
The contract between you and EVADE HOUSE is formed when we confirm that your order has been accepted. Where applicable, acceptance may be confirmed through a shipping confirmation email.
If we are unable to accept your order, we will inform you as soon as reasonably possible and refund any payment already made.
We reserve the right to refuse or cancel an order where reasonably necessary, including in cases of:
- product availability issues;
- an obvious pricing or product information error;
- suspected fraudulent or unauthorised activity;
- delivery restrictions;
- technical errors; or
- circumstances beyond our reasonable control.
If we cancel an order after payment has been made, we will refund the amount paid using the original payment method.
9. Payment
We accept the payment methods displayed at checkout.
Payments may be processed through third-party payment providers, including Shopify Payments and PayPal.
By submitting payment information, you confirm that you are authorised to use the selected payment method.
Payment information is processed through the relevant payment provider and EVADE HOUSE does not have access to your full payment card details where these are processed by the third-party provider.
10. Electronic Communications
By using our website and placing an order, you agree that we may communicate with you electronically, including by email.
You acknowledge that electronic communications may be used to provide order confirmations, shipping information, customer service communications and other information relating to your purchase.
Where permitted by applicable law, you agree that electronic communications satisfy any legal requirement for communications to be made in writing.
11. Production & Delivery
Many EVADE HOUSE products require approximately 2–3 weeks for production and shipping, although delivery times may vary depending on the product, destination and availability.
Products that are already in stock may be dispatched sooner.
Estimated production and delivery times are provided in good faith and may vary.
Where applicable, estimated delivery information will be provided during the purchasing process.
Once your order has been dispatched, you will receive shipping information where available.
Delivery times may be affected by circumstances outside our reasonable control, including customs clearance, carrier delays, severe weather, strikes or other disruptions.
If we are unable to fulfil an order within the applicable legal timeframe, you will have the rights available to you under applicable law.
Delivery Information
You are responsible for ensuring that the delivery information provided when placing your order is accurate and complete.
EVADE HOUSE cannot be held responsible for delays, failed deliveries or additional costs resulting from incorrect or incomplete information provided by the customer, including an incorrect delivery address.
If you realise that the delivery information provided with your order is incorrect, please contact us at shop@evadehouse.com as soon as possible. We will make reasonable efforts to assist, but cannot guarantee that changes can be made once an order has entered production or been dispatched.
12. International Orders & Customs
We ship internationally to destinations available at checkout.
Customers purchasing from outside Spain or the European Union are responsible for complying with any applicable import requirements in their country.
Import duties, customs charges and local taxes are not included unless expressly stated otherwise and remain the responsibility of the customer.
If a customer refuses to pay applicable customs duties or charges and the parcel is returned to EVADE HOUSE, any costs incurred by EVADE HOUSE as a result may be deducted from any refund where permitted by applicable law.
13. Delivery & Risk
For consumer purchases, responsibility for the goods remains with EVADE HOUSE until the products are physically received by you or by a third party designated by you, other than the carrier.
If you believe that your order has been lost, damaged or incorrectly delivered, please contact shop@evadehouse.com as soon as possible.
Nothing in these Terms & Conditions affects any mandatory rights you may have under applicable consumer protection law.
14. Returns & Exchanges
Our commercial returns and exchange policy is available on our Returns & Exchanges page.
As a general rule, EVADE HOUSE accepts returns and exchanges within 30 days of delivery, subject to the conditions set out in our Returns & Exchanges policy.
Sale items and custom-made or personalised products are not eligible for return or exchange, except where applicable law requires otherwise.
Made-to-order products are not automatically considered custom-made products.
Nothing in our Returns & Exchanges policy limits or excludes any mandatory consumer rights available to you under applicable law.
This 30-day period is a voluntary commercial return policy offered by EVADE HOUSE and is in addition to, and does not replace, any statutory right of withdrawal or other mandatory consumer rights that may apply to your purchase.
15. Statutory Right of Withdrawal
If you are a consumer located in the European Union or another jurisdiction where a statutory right of withdrawal applies, you may have the legal right to withdraw from your purchase without giving a reason.
For EU consumers, the standard withdrawal period is 14 days from the date on which you, or a third party designated by you, receive the goods, subject to applicable legal exceptions.
To exercise your right of withdrawal, you must clearly communicate your decision to withdraw before the applicable withdrawal period expires.

If you exercise your statutory right of withdrawal, we will reimburse the payments received from you in accordance with applicable law.
Where required by law, this includes the cost of the standard delivery option originally selected by you. We are not required to reimburse additional costs resulting from your choice of a more expensive delivery method.
You may be responsible for the direct cost of returning the goods where we have informed you of this obligation before purchase.
We may withhold reimbursement until we have received the returned goods or you have provided evidence that the goods have been sent back, whichever occurs first, where permitted by law.
The right of withdrawal does not apply to products falling within legally recognised exceptions, including goods made to the consumer's specifications or clearly personalised, where the applicable legal requirements are met.
16. Condition of Returned Products
When exercising a statutory right of withdrawal, products should only be handled to the extent necessary to establish their nature, characteristics and functioning.
If a product has been handled beyond what is necessary and its value has consequently diminished, EVADE HOUSE may be entitled to claim the corresponding reduction in value where permitted by applicable law.
Our commercial Returns & Exchanges policy may establish reasonable conditions for voluntary returns beyond the statutory right of withdrawal, provided that these conditions do not restrict mandatory consumer rights.
17. Defective or Non-Conforming Products
If you receive a product that is defective, damaged or does not conform to the contract, please contact shop@evadehouse.com as soon as possible, providing your order number and, where appropriate, photographs of the issue.
Your statutory consumer rights remain unaffected by our commercial Returns & Exchanges policy.
For purchases subject to Spanish consumer law, EVADE HOUSE is responsible for lack of conformity in accordance with the applicable statutory guarantee period.
For goods, Spanish law currently provides a three-year period of responsibility from delivery.
Where a product is defective or otherwise fails to conform to the contract, you may have rights including repair, replacement, price reduction or termination of the contract, depending on the circumstances and applicable law.
Where required by law, remedies for defective or non-conforming products will be provided without charge to the consumer.
This section does not affect any additional rights you may have under the mandatory laws of your country of residence.
18. Underwear
Underwear is subject to the same statutory consumer rights as other products, except where a specific legal exception applies.
EVADE HOUSE does not exclude the return of underwear solely because it is underwear.
Any restrictions relating to the return of a particular underwear product will only apply where permitted by applicable law and will be communicated through our Returns & Exchanges policy.
19. Intellectual Property
All content on the EVADE HOUSE website, including but not limited to:
- photographs;
- product images;
- designs;
- graphics;
- logos;
- trademarks;
- text;
- videos;
- illustrations;
- layouts; and
- other materials
is owned by or licensed to EVADE HOUSE and is protected by applicable intellectual property laws.
You may access and use the website for personal, non-commercial purposes.
You may not reproduce, modify, distribute, publish, sell or commercially exploit any website content without our prior written consent.
Nothing in these Terms & Conditions grants you ownership of, or any licence to, EVADE HOUSE intellectual property except for the limited right to use the website in accordance with these Terms.

Our website may use third-party services and platforms, including payment providers, hosting providers, analytics services, shipping providers and other technology providers.
These services may be subject to their own terms and privacy policies

EVADE HOUSE is not responsible for the content, availability, security or privacy practices of third-party websites or services.

We aim to keep our website available and functioning properly, but we do not guarantee that the website will always be available, uninterrupted or free from errors.
We may temporarily suspend or restrict access to the website for maintenance, updates, security or other operational reasons.
Nothing in this section excludes or limits liability that cannot legally be excluded or limited.
22. Limitation of Liability
To the maximum extent permitted by applicable law, EVADE HOUSE will not be liable for losses arising from:
- circumstances beyond our reasonable control;
- interruptions or failures of third-party services;
- misuse of the website;
- failure to follow product care instructions; or
- indirect losses that are not reasonably foreseeable at the time the contract was entered into.
Nothing in these Terms & Conditions excludes or limits liability where such exclusion or limitation is prohibited by law, including liability for fraud, intentional misconduct, death or personal injury caused by negligence, or mandatory consumer rights.
For consumers, nothing in these Terms & Conditions limits the statutory rights and remedies available under applicable law.
23. Force Majeure
EVADE HOUSE will not be responsible for delays or failure to perform its obligations where such delay or failure results from circumstances beyond our reasonable control.
These circumstances may include, without limitation:
- natural disasters;
- severe weather;
- war;
- terrorism;
- civil unrest;
- strikes;
- government restrictions;
- pandemics or public health emergencies;
- transport disruptions;
- customs delays;
- failures of third-party logistics providers; or
- significant failures of telecommunications or infrastructure.
Where reasonably possible, we will notify you of significant delays and take reasonable steps to minimise their impact.
24. Waiver
Our failure to enforce any provision of these Terms & Conditions shall not constitute a waiver of our right to enforce that provision in the future.
25. Severability
If any provision of these Terms & Conditions is found to be invalid, unlawful or unenforceable, that provision shall be interpreted or amended to the minimum extent necessary to make it valid and enforceable, where permitted by law.

These Terms & Conditions, together with the policies and information expressly referred to in them, constitute the agreement between you and EVADE HOUSE in relation to your use of the website and purchases made through it.
Nothing in this section limits or excludes any rights or remedies that cannot legally be limited or excluded under applicable law.

We may update these Terms & Conditions from time to time.
The version applicable to your order will be the version in force at the time the order is placed.
Any changes made after your order will not affect the terms applicable to that order unless required by law.
28. Applicable Law & Jurisdiction
These Terms & Conditions are governed by Spanish law, without prejudice to any mandatory consumer protection rights that apply in the country where you reside.
If you are a consumer, you may benefit from mandatory provisions of the law of your country of residence where applicable.
Nothing in these Terms & Conditions limits your right to bring proceedings before the courts available to you under applicable consumer protection law.
Where legally permitted, disputes with customers who are not consumers will be subject to the jurisdiction of the courts of Madrid, Spain.
